With express intention for publication here, are the thoughts submitted by Familie Majhoubi Assil:

„Michael Wildes, a prominent New York immigration lawyer, said it's "extraordinary" to see asylum being granted to people coming from a nation with which the U.S. has strong diplomatic ties and a military alliance.”

“But Mr. Wildes said the judge made the right decision. “

"This intolerance does not reflect well on Germany, and frankly, as a Holocaust survivor's grandson, gives me great pause that they don't get down the slope they are embarking on," Mr. Wildes said. "Appreciation of diversity, ethnicity and tolerance needs to be part of Germany's DNA, and it's disturbing if this is the path that nation is once again headed on."

Was haben unsere Kinder dort eigentlich verloren?

The comments of Mr Wildes, the grandchild of a Holocaust survivor in response to the article "Homeschoolers win Asylum in the US" in the Washington Times, 28.01.2010 are worth reading:

"Michael Wildes, a prominent New York immigration lawyer, said it's "extraordinary" to see asylum being granted to people coming from a nation with which the U.S. has strong diplomatic ties and a military alliance.”

It is a scandal that we, German homeschooling families must still flee or rather that we must flee as a result of the persecution and violence of the German "Youth Office". It is distressing to leave ones homeland, but escape from Germany is inevitable when one considers protecting the physical and mental health of our children from the violence of the "Youth Office" with their own forceful weapon in the form of the police.

Many good and decent families are displaced and persecuted who want the best for their children. Everyone knows that in fact children are not learning in German schools and accordingly are taught nothing by the teachers. Either the parents must teach their children their schoolwork again in the afternoons, or the kids are bored to death in class. Violence, immorality, alcohol and drugs are there on the agenda there and everything is underwritten by the boards of education and Ministry of Culture . What have our children actually lost there?

Compulsory school attendance should be abolished, so that parents can peacefully find the best possible educational opportunities as well as future prospects for their children. Compulsory school attendance laws from of Hitler's day are used against homeschoolers by all means of violence and without a shred of reason. How can this ever be compared with the always discussed past German Holocaust?

According to Judge Lawence O. Burman homeschoolers in Germany are a persecuted minority.

Even lawyers do not dare say anything against the youth welfare office or fairly plead for families, as this could likely hurt their career in Germany.

Even parental custody is withdrawn because of the so-called breach of compulsory school attendance. Families are extradited from the European countries under the Schengen Agreement on grounds of child abduction, without checking the facts, even though homeschooling is permitted there.

Germany sells itself with a good outward IMAGE and distributes much of the taxpayers' money in Europe and elsewhere in the world, so that a blind eye is turned to "human rights violations in Germany." It is time that something changes, so it could be the first ray of sunshine that the immigration court in Tennessee / USA has made a positive decision.

Although we sent our son, for two years after our escape, to an international school, we still can not return to our homeland, and live in exile. Prosecution still remains in Germany, even the stay abroad for us was determined by the court. It goes without saying once again that our family opted for homeschooling, and finally you also get the best of distance-education materials for the education of children anywhere in the world except Germany.

Not only Homeschoolers are in Germany a persecuted target group, but all families - parents and children - who do not run conform with the German Jugendamt, the German political (national socialist) Family Judge and Police officer (Gestapo).
Please understand that the homeschoolers only one group among so many others, that are persecuted in Germany. The main group is the group of non-German parents.

Yes, Olivier, that is now more apparent.

It highlights a pervasive mind-set doesn't it?!

Where does that come from?

Familie Mahjoubi Assil have let me know that they have legal custody once again for their son, Marian.

It is not that unusual for the German government once they have ascertained that the family are no longer resident in Germany to award custody back to the parents, but still it must be quite some relief to this mum and dad.

They also say:

Marian is making his Final Tests for the 5. Grade.

All the best Marian with those exams.

Angel wishesThis post (hopefully the first of a series) has been opened up to any resident or emigrated German homeschooler or proponent of learning freedom that wants to express their christmas wishes. They speak for themselves:

Familie Mahjoubi Assil

Dear Friends of Educational Freedom,

We wish for a fair education requirement in the Federal Republic of Germany and the fall of Nazi-forced school attendance, so that innocent children can again experience joy in learning.

That can only come about, when we all work together for the rights of the children and the important institution of the family, showing that we as parents play a crucial role for the future of the country.

Merry Christmas and a healthy year in 2009.

The Mahjoubi Assil family, who fled Germany for safety in Iran were given Hobson's choice of leaving the country permanently otherwise they stood to lose custody of their son.

Three months on they still do not have this decision in writing.

Here is the latest plea from their lawyer to the Frankfurt High Court.

Original GermanOffered English translation
Wir erinnern daran, dass unsere Mandantschaft dringend darüber Rechtsklarheit benötigt, welches Gericht nun zuständig ist und welche Entscheidung in der Sache getroffen wird, falls das OLG Frankfurt am Main zuständig sein sollte......Regarding the parental custody of Marion Mahjoubi Assil, no decision has been made known to date, despite several requests and despite the advice of the High Court of 2 October 2008 that the decision would be remitted at the end of October, beginning of November. We are reminded of our clients urgent need for legal clarification, about which court has jurisdiction and what decision is to be made in this situation, in case the Frankfurt am Main High Court should be responsible...

The Status Quo

For those new to the situation in Germany: home educating is (perceived as) illegal.

The common citation for forced school attendance is to protect against parallel societies.

Educating Germany discusses arguments for (and against) legalising home education in Germany.

We report on human rights violations; provide translations of media articles, interviews, court hearings and personal stories into English; and suggest practical ways people, internationally, can lobby for change and support those who long for freedom of education.
